Death penalty changes everything in Casey Anthony case

The State has announced it will seek the death penalty for accused child killer Casey Anthony.

From the trial location to the cost being levied on taxpayers - the implications are endless.

Diana Tennis, who has a dozen capital murder trails under her belt, says Casey's defense team will first have to convince a judge it's qualified to try the case.

"You're talking six, seven, eight hundred hours preparing for these cases," Tennis said.

Florida statute requires that lawyers who defend death penalty cases meet strict qualifications.

"I'm doubtful that any of the lawyers currently involved in this case meet those requirements," Tennis said.

Defense spokeswoman Marti Mackenzie told me the team does have a member who is death-penalty qualified, but she wouldn't specify who.

Tennis said the decision by prosecutors to pursue the death penalty will add years to the trial and up to an additional $1 million to the bill taxpayers will have to foot.

She believes Casey's lawyers will declare her indigent - allowing them to charge the State for everything from lawyer fees and expert witnesses to court reporters and depositions.

Tennis also believes this will make it more likely the trial will be moved to a location outside of Orlando.

And bring on the special interests that feed off the death penalty issue.

"This is the exact kind of case that is going to be seen as pulpit for everybody who ever wants to have a pulpit," Tennis said.

What others are saying

  • Death penalty for Casey
I think you do a great job, Drew. I'm just wondering why we would have to pay for this "dream team" for Casey. If this is the case, everyone who is indigent should be able to hire any attorney or expert witness they want!
  • Typo
We don't have editors. We do everything from conducting the interview and chopping the audio for air to writing the story and posting it online. Thanks for reading. Sorry for the error.
  • To "Literate One"
Literate One - Perhaps you should consider the possibility an editor dropped the ball and did not see this error. It could also be a typo that slipped past. You are correct in your assessment of this particular word, but for some reason I believe you may very well be an Anthony family member or supporter as it seems to me most folks would not get that upset over such a minor error.
  • Mutilation of the English Language
"Your talking six, seven, eight hundred hours preparing for these cases," Tennis said.

NO! YOU'RE, as in "YOU ARE talking". Y-O-U-R is possessive. Learn the difference before you become a journalist, please.
  • Where to PUT the NEEDLE ...
Whenever Baez speaks to media, he makes his inexperience more of an issue. With his VAST [4-whole YRS] legal practice, he’s determined "THIS IS NOT A DEATH PENALTY CASE?" Judging from Orlando media polls, opinions are 87% FAVORING the death penalty.
Caylee was tortured; left ALONE God knows WHERE in the dark, drugged, duct-tape pressed covering her mouth/nose & wrapped around her HEAD. Imagine it: DESERTED, alone; days later, her tiny body stuffed in garbage bags. FL jurors will look at their children & pets …then gladly stick the needle in themselves.
