Casey Anthony's attorneys fight back on fraud case trial date
It's a battle that's been brewing between the state and Casey's defense for months.
New motions filed by Anthony attorneys Jose Baez and Dr. Andrea Lyon argue the defense cannot afford to waste precious time and resources on a fraud case, with the capital case hanging over their heads.
"The complexity of the capital case necessitates a delay in the check forgery case," the motion reads.
Baez and Dr. Lyon argue that forcing them to divert their attention away from Casey's capital case would impede her right to a fair trial.
The motion says the state's delay in their decision to seek the death penalty for Casey has added to the defense's workload and forced them to bring on an additional attorney(Dr. Lyon) who needs time to catch up on details of the case.
Furthermore, the defense argues, there will be no harm in delaying the fraud case because the alleged victim in the case, Amy Huizinga, has already been compensated by her bank. And Baez's firm reimbursed the bank for more than $600.
Finally, the defense says Casey has already served more time in jail than a person would for a first-time conviction on a crime of that type.
The motion asks judge Stan Strickland to delay the fraud trial until after she's tried for killing her daughter Caylee.
Other motions:
The defense is seeking to quite the bounty hunter who first bailed Casey out of jail.
They argue that because bounty hunter Leonard Padilla and his team provided security for Casey, they're considered "agents of the defense."
Therefore, what they saw and heard is privileged information.
Padilla has been no stranger to national television, often commenting on what he and his team heard during their time inside the Anthony home.
Miss Anthony's defense wants to make sure that insight isn't available to the prosecution.
Another motion filed by the defense labels Equusearch founder Tim Miller a "material witness" and seeks records of searches for Caylee Anthony.
The defense wants records of search locations and volunteers.
