Seldom-used law may force Casey Anthony to trial
A judge has postponed Casey Anthony's capital murder trial until next year. But the prosecution is pushing for a jury to hear her fraud case now - something the defense has argued against.
Orlando attorney Mark NeJame, who once represented George and Cindy Anthony, says the two sides are battling for position.
"The prosecutor is surely going to want to try the easiest case first so they get a conviction on the record," he said. "That way, when they're prosecuting the defendant, they're now prosecuting a convicted felon."
NeJame says the state is also looking to bring out any information that could be useful during the murder trial.
Casey's defense, according to NeJame, wants the opposite - prevent a fraud conviction and suppress evidence and testimony that could hurt them later on.
Publicly, the defense has argued that holding the fraud trial first would impede Casey's ability to get a fair shake on the more serious charges.
But, the state and the victim have a right to a speedy trial in Florida. It's part of a seldom-used law passed in 2005.
In court this week, prosecutors announced that Casey's former friend, Amy Huizenga(alleged victim in the fraud case), will invoke that statute and seek to force the trial to begin now.
Casey's defense promised to counter, but NeJame says it's an uphill battle.
"I think that it may be time to go to trial on the fraud case," he said.

Legal Assistant, they are not "in denial," they are simply denying. In denial says that they can't accept the facts.
They are denying what they know fully well is true and have no more remorse than the scum they raised.

What rock have you been under??? We only know what the media wants us to know?? You are stuck on stupid...I've read hundreds...no...over a THOUSAND pages of discovery documents that the media didn't create. They only distributed it to us so we can dissect the case ourselves.
Also, she can't be put to death for being found guilty on the check/fraud charges. (though I wish she could be) The article is about a speedy trial for the victim Amy. It will not rush her murder trial. DA. - isnt it ironic that that seldon used law that will get this fraud case off the ground was passed in 2005??? the same year little Caylee was born! hmmmmm... karma?
- If it was meIf I was an innocent person who had been wrongly accused, I would want rapid justice. I would demand my right to a speedy trial. I certainly would not want to spend two years in jail awaiting my trial, especially if I was accussed of murdering my own child. I would want to clear my name, be released from jail, and find the "real killer" of my helpless child. Isn't that what we all would do???

She DOESN'T have more protection and rights than any other criminal defendant. When a State elects to go for the death penalty, it's a deliberate choice to drag the trial out forever and at least triples the cost of the trial itself, not to mention all the appeals that will follow (and there will be plenty of appeals, some of them justified). You people wanted her lynched so you're just going to have to put up with the legal contortions necessary to do so. The fact that many INNOCENT people have been convicted and some executed is what has led to the slow and steady pace of capital punishment cases. I am NOT saying Casey is innocent but until she has her day in court, only a jury can find her guilty. That's the law. If you don't like it, go live somewhere else. - Casey AnthonyShe will just copa plea and wait for the murder trial. In the end the best bet here is drop the death penalty although she deserves it and go for life. This way Baez is on his own and there's no way he can win that way since he's no more than a publoicity slut sho wants his name in bright lights next to Casey. If justice is to be swift convict her of the murder, sentence her to life and let prison take its toll on her. she will never see the light of day and GOd only knows how long she will need to be secluded so noone brings justice down upon her in Caylee's name. Just forget about frying her and toss her to the wolves.
- Guilty?This situation is ridiculous. First of all, Casey ends up with a rather stupid attorney who is the one who loves the limelight. Let us remember it is HE who thinks he will profit from all of this! If he were qualified, he would not be bringing in all these other attorneys to work this case.
While Casey is clearly manipulative and mentally unstable, I believe it is her attorney who insisted all along that she remain mum regarding the murder of Caylee. I also wonder what kind of relationship the two of them really have going...
Casey committed the crime of fraud and theft and should stand trial. It has been proven that not only did she steal from a friend, but also her own parents and grandparents. She is guilty.
Where will this situation end? Who only knows.

Speedy trial for the victim of theft? Absolutely!
The cost of all of this will be astronomical for the state of Florida before it is all said and done. Not only that, but had Casey simply told the truth, whatever that may be, much sorrow and grief could have been avoided for everyone.
The loss of Caylee is tragic but with everything else - the lies and fabrications - it is much, much worse and cannot be put to rest until the truth comes out. Even then, however, will her parents ever come to the place of believing the truth? Doubtful.
Get her in the courtroom and get this matter resolved.
I am glad I do not live in the state of Florida! I would be furious at the cost of it all. - She did the crime...It is caught on tape. She stole. There are laws against it and it is only right that she stand trial as the judicial system deems fit. She is lucky she is only being tried on the theft from one person, rather than all who she has stolen from. It is her own fault she has an even more serious case also looming against her. Time to face her lumps.
- Too much money invested into this...Sherri, Casey will NEVER come clean... if she did come clean, the case would be closed and off to prison she'd go. How many people are sitting in jail for 20 - 30 years that aren’t guilty – you here their stories all the time.
And Yes the victims deserves justice. However this woman could be put to death. Now I’m not saying she’s guilty or not ( I really don’t know) , however before I can commit to putting anyone to death I would need to hear both side – None of you have heard both sides, you heard what the media wants you to hear.

- This has been dragged out too long already. I say get on with it and let the chips fall where they may. Crimes were committed, lets see some prosecution. This entire situation needs to be looked at closely. Bad enough tax payers $$ has to pay for all of this but atleast get some action started. Casey doesnt see the seriousness of this. She is snacking her time away like she is at camp. Get the ball rolling!
