Heirs want piece of Disney/Marvel merger

As Disney and Marvel work out the details of their $4 billion deal, the estate of Jack Kirby is looking to reclaim the rights to some of his more well known creations such as The X-Men, The Hulk and The Fantastic Four.

Everything that Kirby created while at Marvel belonged to the company. He left marvel in the 70's and died 15 years ago.

Copyright laws allow that after 56 years, the rights can be recaptured by the creator or his family. Those rights will begin to expire in the next decade and the family has served Disney notice that they want them.

It doesn't mean Disney can't use the characters, but it does mean they may have to pay the family half of any royalties - and the family will also have the right to license out those franchises.
