LIVE BLOG: Lisa Nowak hearing
Ex astronaut Lisa Nowak is back in an Orange County Courtroom for the first time two years for a pretrial hearing that's expected to end with a plea bargain.
1:33pm - the courtroom doors are open and Nowak, her alleged victim Colleen Shipman and attorneys are entering.
1:35pm - Judge Marc Lubet is calling the court to order.
1:36 pm - Lisa is sitting quietly next to her attorney, a slight smile across her face.
1:37 pm - Attorney Don Lykkebak is entering a plea of guilty to burglary of a conveyence and guilty to a charge of battery.
1:38 pm - In return, the state is dropping one of the charges against her.
1:39 pm - Nowak is at the podium telling the judge that she agrees to the plea and understands the meaning behind her decision.
1:40 pm - Nowak was asked about her education. She replied that she earned a master's degree in aeronautics. Judge Lubet then asked her, with her level of education, if she freely understood the consequences of the decision to plea guilty to two of the three charges. She is affirming her signatures on the plea forms.
1:41 pm - Nowak is asked what her plea is: "guilty" she said to both.
1:42 pm - She was asked if she understood the penalties involved, She said yes.
1:43 pm - Lubet accepted her pleas.
1:44 pm - A sentencing hearing is beginning and Colleen Shipman is taking the podium for the state. She has prepared a statement.
1:46 pm - Shipman almost broke out in tears as she began. She told the court that Lisa Nowak "hunted me down and attacked me in a parking lot."
1:47 pm - I knew in my heart, she was going to kill me, said Shipman.
1:48 pm - She said she saw "limitless rage" in Nowak's eyes that night at OIA. She claims Nowak researched murder and dismemberment.
1:49 pm - Shipman further told the court that Nowak stole her personal information from the home of her boyfriend in Houston, then astronaut Bill Oefelein, and used that information to find her at the airport and plot an attack.
1:50 pm- Shipman said the attack her crippled her emotionally to the point where three years of counseling has not helped. she sleeps with the light on and has nightmares of being killed.
1:56 pm - Shipman has finished her statement.
1:57 pm - Nowak's attorney Don Lykkebak is telling the court that Nowak is still in the Navy and performs her duties in an exemplary manner. He reminded the court of her education and good work record.
2:00 pm- Lykkebak said Nowak is pleading to a third degree felony, the lowest form under the law. He said Nowak acted "out of character" in what has been an "outstanding life."
2:03 pm - Nowak is testifying. She turned to face Shipman and apologized.
2:03 pm - "I'm sincerely sorry for causing you fear and misunderstanding. I hope we can all move forward in privacy and peace."
2:05 pm - Prosecutor Pam Davis is talking to the court now. She is standing with arms crossed, off mike, saying that this is no ordinary case and Nowak should not be given leniency.
2:09 pm - Lykkebak said Nowak is being overcharges, but Davis points out that Nowak "stalked" her victim and needs to be sentenced appropriately.
2:11 pm - Judge Lubet said he has looked at Nowak's conduct since her arrest and the court believes her apology "is sincere."
2:12 pm - It's long been a mandate that people are sentenced similiarly, he noted.
2:12 pm - You are 100 percent responsible for that nightmare. I believe you have accepted that, he said.
2:12 pm - Lubet is withholding adjudication. Sentenced to two days in jail, with credit for two days already served. One year probation. No prison time. 50 hours of community service. Absolutely no contact of any sort with Colleen Shipman, including third party contact. Only a sincere letter of apology within 10 days. He added one hour of anger management counseling. No contact with Bill Oefelein, either. "No books, no messages, no poems," ordered Lubet. "I understand," said Nowak.
What others are saying
- Similarity to Alaskan murder/suicide in 2002Billy & Colleen are living in Alaska and plan to marry next year. BTW, he was allowed to retire from the Navy, and was not thrown out or jailed, like you want to do to Lisa Nowak.
Colleen looks ten years older than her age, and I think all that is holding them together are shared secrets. I'll drag out the ole tinfoil hat and say that this mess resembles a fairly notorious murder/suicide/triangle in 2002 in Alaska, and maybe they set Lisa Nowak up to be the psycho GF.
She is lucky she escaped being set up to commit suicide -- which is how the other case ended. Billy has connections up here and would have known about the other case. Oh - and check out their website and see just how "scared" she sounds - compared to the grandiose plans of two adrenaline junkies. He'll find a way to dump her in a few years - lots of room in this state. Or maybe she'll get him first.
Whatever. Maybe the Navy suspected this but couldn't prove it, so they left her alone. The poor woman deserves some peace. - Why is Nowak still employed and paid by the Navy for a do nothing stashed job?Lisa Nowak was a Navy Officer married with 3 kids, in an adulterous with another then married Air Force Officer, who was carrying on with even another Air Force Officer. It was an obvious premeditated murder plot attempt that was only foiled by the victim's ability to escape. Adultery alone is grounds for a court martial or administrative discharge from the military, especially in the case of an officer. I know of many cases where individuals were drummed out of the service for much lesser offenses, not withstanding the assault and premeditated attempted murder charges. How the heck do you get to continue in, and possibly get a fat retirement check from the Navy as a high ranking Captain (equivalent to a Colonel in the other services)and get off with one year probation for a misdeneanor for that!?!. Smells like gender bias and politics preferential treatment to me!
- Live BlogExcellent job, Joe!
- lisa nowakso just because she was a naval astronaut that excuses her psychotic behavior and plot to kill someone?? can't wait until her next jealous tantrum where she isn't stopped and that person ends up dead.......
only in america - Lisa NowakI agree with the judges' ruling. Lisa is of much greater value to the Navy than aging in jail.
I truly hope she has gotten over her passion for two timing Billy and for revenge.
How many of us had those thoughts but never acted them out?
Bill Oefelein is the guilty party here.
I hope the Navy reassigns him to Antarctica for research on hydrodynamics
of the penguin for at least a few years. - Nowak and ShipmanDon't mess with love. Dangerous and very human responses result. The boyfriend is hardly guiltless here. Two timer.
