Nowak may plead this afternoon
Ex-astronaut Lisa Nowak is less than a month away from her trial for burglary of a conveyance and attempted kidnapping in an attack on romantic rival Colleen Shipman at Orlando International Airport in February 2007. Word is she plans to strike a plea deal at her Tuesday pre-trial hearing before Judge Marc Lubet.
Shipman was supposed to submit to a deposition by Nowak's legal team who discovered contradictory statements made by Shipman to emergency responders after the attack."If we discovered it during trial, it'd have been a mistrial," said Nowak's lead attorney Donald Lykkebak last month.
Nowak drove from her Houston home to Orlando International Airport to confront Shipman, who was on a late night flight from Houston after visiting astronaut Bill Oefelein, who was breaking up with Nowak.
Shipman was an Air Force officer living at that time in Melbourne, Florida.
Nowak had several items in her car, including a BB pistol and ammo, pepper spray, a folding knife, a wig and trench coat.
Surveillance video shows Nowak wearing the wig while waiting for Shipman at airport baggage claim.
Police later found it tossed in a trash can.
According to police, Nowak approached Shipman after she got into her parked car and convinced her to roll down her window at which point she allegedly used the spray in an effort to disorient Shipman and get into her car.
A judge threw out the evidence found in Nowak's parked car and her statements to Orlando police after her arrest that morning. An appeals court allowed the evidence back in, but not her statements.
Trial is scheduled for December 7, but her plea deal could bring those proceedings to a halt. Expect a media throng at the Orange County Courthouse. WDBO will blog live from hearing.
