Former Expressway Authority board member Marco Pena to plead guilty

Marco Pena will plead guilty in Orange County court for breaking state laws, which prohibited him from talking about Expressway Authority business in private.

State attorney Jeff Ashton announced the plea Tuesday afternoon.

Pena is expected to go before Judge Carolyn Freeman Wednesday morning and plea guilty to one misdemeanor count of violating Florida's Sunshine Laws.

A grand jury has been investigating the Expressway Authority for months, indicting board member Scott Batterson on three bribery related charges.
